Petscovery Terms & Conditions

1. About These Terms

These terms and conditions ("Terms") govern your use of the Petscovery website and application ("Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.

The Service is operated by Petscovery ("we", "us", "our"), a sole trader based in the United Kingdom.

If you do not agree to these Terms, you must not use the Service.

2. The Service

Petscovery is a platform that helps pet owners discover their pet's family connections. Users can register their pets, upload photographs, and find potential littermates through automated matching based on birth location and date of birth. Certain features, such as unlocking a litter, require a one-time payment.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have the consent of a parent or guardian to use the Service.

By creating an account, you confirm that the information you provide is accurate and complete.

4. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must not share your account with others or allow unauthorised access.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at hello@petscovery.com if you suspect unauthorised access to your account.

5. Payments & Refunds

Certain features of the Service require payment. All payments are processed securely by Stripe. We do not store your card details.

By making a purchase, you acknowledge that you are buying access to digital content. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you agree that the digital content is made available to you immediately upon payment and that you lose your right to cancel once the content has been accessed.

All purchases are final. Refunds are not provided once a litter has been unlocked. If you believe a payment was made in error, please contact us at hello@petscovery.com.

If a pet owner whose profile you have paid to access subsequently deletes their account, their pet's photos will be retained in anonymised form so that your paid access is preserved. Basic pet profile information (breed, date of birth) will also be retained for the same reason.

6. User-Generated Content

License Grant

By uploading content (including photographs) to the Service, you grant Petscovery a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display your content for the purposes of operating the Service and for marketing and promotional purposes.

This licence ends when you delete your content or your account, except where: (a) content has already been published in marketing materials prior to your deletion request — it may remain in those materials, and we will not use your content in any new marketing materials after deletion; or (b) another user has made a payment to access your pet's profile — in that case, photos associated with that pet may be retained in anonymised form (no longer linked to your account or identity) to honour that paid access.

Your Responsibilities

• You confirm that you own or have the right to upload all content.
• Content must not infringe any third-party rights.
• You are solely responsible for the content you upload to the Service.

Prohibited Content

Content must not contain:

• Hate speech, harassment, or abusive material
• Obscene, violent, or unlawful material
• Copyrighted material without the owner's permission
• Content that violates any person's privacy

Content Moderation

We reserve the right to remove any content at our discretion, without prior notice, if we believe it violates these Terms or is otherwise inappropriate.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Create multiple accounts for abusive or fraudulent purposes
• Impersonate another person or misrepresent your affiliation with any person or organisation

8. Intellectual Property

All intellectual property rights in the Service (including its design, code, branding, and trademarks) belong to Petscovery or its licensors. Nothing in these Terms grants you any rights to use our intellectual property except as expressly permitted to use the Service.

9. Third-Party Services

The Service integrates with third-party providers including Firebase (authentication), Stripe (payments), and Cloudflare (image storage). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

10. Availability & Disclaimers

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

While we strive to ensure the accuracy of littermate matching, we cannot guarantee that matches are correct. Pet family connections suggested by the Service are based on the data provided by users and should not be treated as verified pedigree records.

11. Limitation of Liability

To the fullest extent permitted by law, Petscovery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Petscovery, its affiliates, and employees from all claims, liabilities, damages, and expenses (including legal fees) arising from:

• Your breach of these Terms
• Your use of the Service
• Content you upload that infringes third-party rights
• Any violation of applicable laws

13. Account Termination

You may delete your account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, without prior notice. We will notify you of the reason where possible.

14. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by posting a notice on the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you retain any mandatory consumer protection rights under the laws of your country of residence.
